Terms of Service
These Terms of Service govern access to and use of the EduConnect platform, the marketing website and everything we make available around them. Please read them carefully — by using EduConnect you agree to them.
1. Agreement to these terms
By creating an account, requesting a demo, or otherwise using EduConnect, you agree to these Terms of Service and to our Privacy Policy and Cookie Policy, which are part of this agreement. If you use EduConnect on behalf of a kindergarten or other organisation, you confirm that you are authorised to accept these terms for it. If you do not agree, please do not use the platform.
2. Definitions
“EduConnect”, “we” or “us” means the provider of the platform. “Service” means the EduConnect web and mobile applications, the website and related services. “Kindergarten” (or “Client”) means the institution that subscribes to the Service. “User” means any authorised person who accesses the Service — administrator, teacher, parent or student. “Children’s Data” means personal data relating to enrolled children. “Content” means any data, text, images or files handled through the Service.
3. Who may use the Service
The Service is intended for kindergartens and their authorised staff, and for the parents and legal guardians of enrolled children. Accounts are created for and by the kindergarten; parents and staff receive access from it. You must provide accurate registration information and keep it up to date.
4. Accounts and account security
You are responsible for the credentials of your account and for all activity that takes place under it. Keep your password confidential, use the security features we provide, and notify us promptly if you suspect any unauthorised use. We are not liable for losses caused by credentials that were shared or inadequately protected.
5. The Service and subscription plans
EduConnect provides tools for kindergarten management — educational planning, attendance, daily journals, documents, invoicing and payments, programs and communication. Some features are available only on a paid subscription. We may add, change or retire features to improve the Service; where a change is material we will make reasonable efforts to inform you.
6. Fees, billing and renewal
Where the Service is provided on a subscription, prices, the billing cycle and renewal conditions are set out at the time of subscribing. Fees are due in advance for each billing period and, unless the law provides otherwise, are non-refundable. Applicable taxes are added where required. We may update pricing for future periods with prior notice.
7. Acceptable use
You agree to use the Service only for its intended purpose and in compliance with applicable law, including data-protection law. You are responsible for the accuracy and lawfulness of the Content you enter, and for obtaining any consents required from the people whose data you record.
8. Things you must not do
You must not: access the Service without authorisation or attempt to breach its security; upload malware or disrupt its operation; copy, resell, reverse-engineer or create derivative works from the Service; use it to store or send unlawful, harmful or infringing material; or use children’s data for any purpose other than the legitimate operation of the kindergarten.
9. Children’s data and the kindergarten’s responsibility
For personal data about children and parents entered into the platform, the kindergarten acts as the data controller and EduConnect acts as the data processor, processing that data only on the kindergarten’s documented instructions. The kindergarten is responsible for having a lawful basis and any necessary consent for the data it records. Our respective GDPR obligations are described in the Privacy Policy and, where applicable, a separate data-processing agreement.
10. Your Content
The Content entered by a kindergarten and its users remains theirs. You grant us the limited rights needed to host, process and display that Content solely to provide and support the Service, to keep backups, and to comply with the law. We do not sell your Content and we do not use children’s data for advertising.
11. Intellectual property
The Service, including its software, design, trademarks and documentation, belongs to EduConnect and is protected by law. These terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription; they do not transfer any ownership in it to you.
12. Confidentiality
Each party may receive information that the other treats as confidential. Both parties agree to protect such information, to use it only in connection with the Service, and not to disclose it to third parties except as permitted by this agreement or required by law.
13. Availability, support and maintenance
We make reasonable efforts to keep the Service available and to provide support. Planned maintenance may cause temporary interruptions, which we will announce in advance where practicable. We do not guarantee uninterrupted or error-free operation.
14. Warranties and disclaimers
The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. You remain responsible for how you use the Service and for the decisions you make based on it.
15. Limitation of liability
To the maximum extent permitted by law, EduConnect is not liable for indirect, incidental or consequential damages, loss of profit, or loss of data arising from your use of the Service. Nothing in these terms limits liability that cannot be limited under applicable law.
16. Indemnification
You agree to hold EduConnect harmless from claims, losses and expenses arising out of your breach of these terms, your unlawful use of the Service, or Content you entered in breach of the rights of others or of applicable law.
17. Third-party services and links
The Service may integrate with, or link to, third-party services (for example payment or email providers). Those services are governed by their own terms and privacy policies, and we are not responsible for them. Your use of a third-party service is at your own discretion.
18. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access where these terms are breached, where required by law, or where continued provision would create a security or legal risk. On termination, your right to use the Service ends; obligations that by their nature should survive (such as due payments and confidentiality) continue.
19. Changes to these terms
We may update these terms from time to time. When we make material changes we will update the date above and, where appropriate, notify you. Your continued use of the Service after a change means you accept the updated terms.
20. Governing law and disputes
These terms are governed by the laws of Romania. We will try to resolve any dispute amicably; failing that, the competent courts of Romania have jurisdiction, without prejudice to any mandatory consumer-protection rights you may have.
21. Force majeure
We are not responsible for failure or delay in providing the Service caused by events beyond our reasonable control, including natural disasters, outages of infrastructure or third-party providers, or acts of public authority.
22. General
If any provision is held invalid, the rest remains in force. We may assign this agreement in connection with a merger, acquisition or reorganisation. Our failure to enforce a right is not a waiver of it. These terms, together with the Privacy Policy and Cookie Policy, form the entire agreement between you and EduConnect regarding the Service.
